You think recognizing that they don't care about your rights is the same as "not resisting"?

The problem is that people don't recognize that their rights don't matter anymore.

Alex Pretti exercised his 2nd amendment right and never broke the law, yet he was executed in broad daylight. It's time to recognize that your rights no longer protect you (just like they rarely ever protected minorites) and fucking revolt already.

15

I read it like that comment have been directed at the article, implying 'know your rights' to be '…and do not resist'

2

None. They said your rights can be waved away at the discretion of any federal agent. Which means your rights don’t exist

115

But you can feel some sort of satisfaction as you count them off just before they execute you.

26
lemmy.world

Sounds like an excellent opportunity to sue them into the ground. A federal officer illegal disregarding your constitutional rights is a payday most can only dream of.

So chill out and lawyer up.

*If you survive. Also you can't sue the government without their consent.

Land of the free and whatever.

Actually no, qualified immunity shields them personally. A tortured precedent, if the exact situation has not happened and been sued on it gets thrown out, or some ridiculous thing like that.

19

oh gods we're talking about all different kinds of immunity here it's not just qualified immunity.

2
lemmy.world

Qualified immunity can be stripped. It's not absolute. Constitutional violations are absolutely grounds for losing qualified immunity.

In theory or what? Last I heard they were virtually immune. Courts are getting worse, not better too, and judges decide.

9

Judges are appointed for life; there's really no reason why they would match lock step with Trumps orders. Yes they're conservative (not all of them), but I don't believe they're going to break the law or compromise their integrity for Trump.

The courts are fucked, we cannot sue our way out of this. Scotus will cancel it with any success, if appeals did not first.

They already barred nationwide injunctions. The admin could round up citizens to concentration camps and no judge can now say stop. You can try to sue individually as if irreperable harm would not have haapened by then if you could even get it into court.

Seriously that was a big deal and media did not realize it. Or tell us if they did. Scotus is nazi.

16

Its almost impossible (especially with this administration) to sue the federal government and win. They have to agree to allow you to sue them before things can even get started.

7

True, so don't do things like obstructing law enforcement and resisting arrest while armed.

-3

Sadly 100% this. These jokers have proved they can just murder folk and nothing happens. Be safe be armed be ready.

27

You de facto do not have a right to have your rights honored though. If an agent wants to put a slug in your head, they will demonize you, maybe persecute your friends and anyone sticking up for you.

The state needs to file open murder charges for both executions. There is nothing to investigate that is a cowardly cop out

startrek.website

Remember kids, murder is against the law. So, if ICE tries to murder you like they did those 2 other people just say, "thats illegal".

They will have no choice but to stop murdering you.

62

ICE has murdered about 50 people so far this year.

They don't just execute white people in the streets. Don't forget that they also operate concentration camps that have been murdering brown people for years

15

Also tell them a judge has decided they cannot destroy evidence of your murder, so they need to carefully document it, or else not at all so there's nothing to save.

10

I don't think the ICE officer will care about your rights, much less about rights that they don't even know...

The labour movement some 100 years back in minneapolis beat the shit out of cops and mafia thugs and strikebreakers trying to break the teamsters union's pickets.

Organized club battles, each with long guns to the side in case, and the teamsters won. Not one battle either this was a protracted struggle, for months or idk how long exactly.

More realistic headline: "Here's a list of things your family can sue the government for after you're dead, once their GoFundMe goals are met".

The only rights you have with ICE are made of lead.

33

Gofundme for victims will be shut down at the government's word. They are one of the worst in that regard I hear.

This is all good information. DHS doesn’t care about constitutional protections. They enter homes with administrative warrants. They can detain anyone, anytime, anywhere.

32

I'm just waiting to hear that news. President Miller wants that to happen. He's setting up all the pieces so it happens as soon as possible.

Stephen Miller is such a little bitch he couldn't even deal with his neighbors in Arlington, VA writing chalk messages on the sidewalk next to his house, so he had to pack up and run away to a military base. What kind of little bitch boy does that? I hope he takes care of himself in the same way that his Nazi heroes did.

19

If you make it out alive, they would almost certainly send you to ADX Florence (or equivalent). Rights and protections are no longer inalienable, if you are part of the fascist regime. Taking a stand, saying “no more!”, is what we should all do. I’m terrified of the prospect of prison. However, at the current rate of escalation, we might all soon face a similar dilemma.

Those rights would count in a country still under the rule of law. Which the US is no longer.

28

Since when has ICE followed laws, or US presidents not been war criminals?

2

Title should be changed to "ysk what legal rights will be violated in encounters with ice"

26

How can you assert any rights when facing a group of masked, armed, thugs?

The masks allow them to avoid any accountability when they disregard your rights.

10

know your rights! All three of them!

You have the right not to be killed

Murder is a crime!

Unless it was done by a police man...

The clash from 1982 still timely

9

At this point assume none, including a right to live. It's good to know in any case.

Studded tires and going slower than the posted speed limit, which normally is the expected speed and you shouldn't go more than 10% slower than it. Those are two rights that come to mind when dealing with ice.

Oh wait ICE means something else in the US. Yeah, good luck guys.

9
feddit.nl

What asshole says you shouldn't go >10% slower than the speed limit.

2
boonhetreply
sopuli.xyz

You can if it's slippery or when there's a corner. Not on a straight dry road with good visibility. That's just pointlessly dangerous

0
feddit.nl

There are very few roads with minimum speed limits. If you're driving the exact same as the speed limit, you're the one that's endangering everyone on the road.

You should always expect a bicycle around every turn that's going 5 mph.

1
boonhetreply
sopuli.xyz

If someone's going >10% over the speed limit, that means other people have to pass them, which is a dangerous maneuver. If they're going the speed limit, only selfish people will pass them.

Police are literally allowed stop you for going 50-60 on a 90 km/h road here in the middle of the summer. It's suspicious and a completely valid reason to check if you're drunk.

around every turn that’s going 5 mph.

But

You can if it’s slippery or when there’s a corner. Not on a straight dry road with good visibility.

I literally said that corners (tight ones anyway) and poor visibility (which corners can cause) in general are valid excuses, in addition to the aforementioned ice. "I was scared of doing 90" is not. I think you're lacking a little bit of reading comprehension. Must be the famously excellent American school system.

1
feddit.nl

You do not have to pass someone who is driving safely. You could, you know, also drive safely

1

I prefer to be as far away from drunk drivers, broken cars and unskilled drivers as possible. So no, I won't drive behind someone like that.

Speed differences are known to be more dangerous than actually going the speed limit. You should have a valid reason for driving slowly. If you don't and can't handle driving at the speed limit, you shouldn't have a license.

Maybe the Ayatollah of Iran should reverse threaten Trump if he doesn't stop killing civilians?

Source? I didn't see gun rights being taken away anywhere in the US. If every protestor was armed with an assault rifle, I doubt ICE would have the balls to kill anyone else in broad daylight

1
Destidereply

The fact that didn't happen after someone died for upholding their 2nd amendment rights is my source. You clearly don't have the right to bear arms Here's my source:

"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

Point to where that happened

1

I said if EVERY protestor was armed with an assault rifle. Search up black panther armed protests for examples of where this worked.

1

I think we're either missing each others points or in a weird agreement. I'm aware of the Philli BP show of force. Every community should do it that way, well articulated calm a show of community that can't be used against them.

The fact is however they aren't in Philly and every where they have been the people have clearly had their rights squashed or are too and rightly so afraid to enforce them.

Your point was second amendment mine was where is it in a meaningful way.

We saw someone disarmed and shot then told not to believe our eyes.

Now what seems to be happening is the second amendment I'd fuelling a rift in the republican party it seems. Iran looks to be the distraction from this whole dark period. But that is something that will prove my comment wrong.

1

You have rights this is america *

  • Rights should be exercised at your own risk... Courts may change their rulings on them at any time, and not even the best lawyer on earth can revive after you've been shot in the head.
7

you have a legal rights to defend yourself with a firearm, which the gop and even tried is trying to discourage from.

5

YSK how to not get killed, maimed, grappled or identified while protesting ICE actions.

3
lemmy.world

You have these rights on paper. In fact you have no rights. It's obey or die.

You voted for this, America. But hey. Kamala wasn't a True Socialist, amirite?

1

Yeah, blame the lefties for not stopping the righties instead of, you know, the righties.

I mean seriously you think that the people who didn't vote for Kamala were such a large portion of the population they outnumber maga? That's wildly optimistic.
