They don't even have to wait to get touched, they can shoot the person charging over to drag them out of the vehicle. The state has to prove the dead parent wasn't going to hurt them. The fact that they got out of their vehicle and headed towards your vehicle on the street would likely be all they needed to prove mal intent, the state wouldn't even try to prosecute that.
