Another reason I really look forward for them being sued in Europe - This is a highly illegal practice in the EU and has already brought sizeable penalties for various other media outlets, both conventional and online.

And weeks ago the Dutch and German consumer protection agencies as well as the GDPR ombudsman already commented that they are looking into Reddit (Reddit has it's European office in Amsterdam).

That will be fun.

Ungeklärte Lungenkrankheiten bei Kindern – WHO verlangt Informationen von China

Da ich mich gerade beruflich damit beschäftigen darf etwas sachlicher als der Spiegel:

Was wir derzeit wissen:

  • Es gibt in Nordchina eine Welle an Pneumonien(Lungenentzündungen) und assoziierten Atemwegserkrankungen bei Kindern.

  • Betroffen sind vor allem die Provinz Liaoning (die westliche der beiden Grenzprovinzen zu Nordkorea) und Beijing.

  • Es sind Fälle bei Erwachsenen, v.a. Lehrern bekannt.

  • Die Kinder entwickeln hohes Fieber, auffällige Lungenrundherde und tlw. Sepsissymptome.

  • RSV, Mycoplasma pneumoniae, SARS-CoV-2 oder Influenza sind eher unwahrscheinlich.

  • RSV: RSV betrifft klassischer Weise eher jüngere Kinder bis 2 Jahre - hier scheinen aber v.a. ältere Kinder im Vorschul-bis frühen Grundschulalter betroffen, ebenso sind die bisher veröffentlichten Befunde eher mit einer aveolären Pneumonie (Entzündung der Lungenblässchen) und nicht der von RSV ausgelösten Entzündung der unteren Atemwege typisch.

  • SARS-CoV-2 aka Covid aka Corona: Hat die PRC ein exzellentes Monitoring mittlerweile, sehr sehr unwahrscheinlich,dass hier eine unerkannte Welle abgeht. Auch weil China eigentlich mittlerweile sehr genau auf neue Mutationen testet. (Oder es zu mindestens behauptet)

  • Influenza: Auch eher unwahrscheinlich - es gibt wenig Indizien dazu und die Fixierung auf Kinder passt da gar nicht zu.

  • mycoplasma pneumoniae: Kann theoretisch sein, aber eher unwahrscheinlich, auch hier passt das Befundbild so gar nicht. Natürlich darf aber eine Mutation nicht ausgeschlossen werden.

  • Momentan scheint eine antibiotische Behandlung wenig Erfolg zu zeigen, eine antivirale ist mir nicht bekannt.

  • Radiologisch auffällige Lungenrundherde sind tatsächlich eher ungewöhnlich,erst Recht bei Kindern.

  • Neben den klassischen Erregern sind normalerweise Pilzinfektionen der Lunge und Tuberkulose gerne mal Verursacher von sowas. Nur: Dann würden wir auch Fälle bei Erwachsenen sehen - tun wir aber ja kaum bis gar nicht. Und insbesondere letzteres braucht ewig um so gut sichtbar zu sein. Zwar sind Pilzinfektionen der Lunge häufiger als man denkt und gerade in dieser Region Chinas durchaus beliebt & in der Fachwelt haben durchaus Leute Angst vor einem "Superpilz", aber das erklärt immer noch nicht die fehlenden Erwachsenen.

Jetzt u.a. daher aber das große ABER:

Wir wissen absolut nicht ob diese ungewöhnlichen Fälle wirklich alle/den Großteil der Fälle die behandelt werden betreffen oder ob nur ein Teil "interessant" war und (oft semi-anonym) veröffentlicht wurde. Wenn du am Tag 30 COVID, 30 RSV, 20 Influenza, 9 bakterielle Pneumonien und einen unklaren Befund hast dann erinnerst du dich natürlich an genau den. Da haben wir momentan einfach zu wenig Daten um irgendwas auszusagen - daher fordert die WHO genau diese ein.

Meine persönliche Theorie ist ja eine Mischung:

Es sind ganz viele normale RSV&v.a. Covid dabei, gleichzeitig ist in China aber mal wieder irgendwas an Bakterien zu einer ordentlichen Resistenz mutiert (Antibiotika in der Tierhaltung sei Dank&dort ist es mit Antibiotic stewardship leider auch in der Humanmeidizin nicht weit) und bildet nun eine Hybridinfektion mit einem stinknormalen, opportunistischen Pilz. Das werden nicht viele sein, aber es ist so ungewöhnlich,dass es vermehrt reportet wird. Covid kann aber gleichzeitig nicht reportet werden weil es nicht opportun ist/die Leute Angst haben,dass es das nicht ist.

Und Tada, haben wir die Situation.

Spannend wäre in der Situation aber wie es in Nordkorea aussieht. Denn da kann der Mist natürlich auch her kommen.

EDITH: Die WHO vermeldet mittlerweile,dass die chinesischen Behörden die Anfragen nun zufriedenstellend beantwortet haben - und zwar dahingehend,dass das die Fallzahlen im wesentlichen von RSV und Mycoplasma pneumoniae herrühren. Das erscheint erstmal auch so logisch, wobei es halt zwei kleine Gegenpunkte gibt:

  • Die veröffentlichten radiologischen Befunde erklären sich damit nicht. Diese können natürlich gefälscht sein, von anderen Fällen kommen oder schlichtweg andere Ursachen haben (es gibt Städte in China und Indien in denen selbst Kinder Lungenkrebs kriegen...), aber es ist schon strange.

  • Muss man leider gestehen,dass weder die chinesischen Behörden nicht immer die transparentesten sind und waren, unabhängig von dem was mit Covid lief und das manche WHO Working Groups leider leichter zu beeinflussen/"naiver" sind als andere. Ich hab leider noch nicht raus gekommen, wer hier mit wem "telefoniert" hat auf working group Ebene. Denn Gruppen wie dem Emerging Diseases Clinical Assessment and Response Network kann man durchaus schon vertrauen. Anderen, eher politischen Gremien eher nicht. (Damit das jetzt niemand in den Corona-Leugner-Hals bekommt: Das ist keine Kritik an der WHO in ihrer Gesamtheit, ich arbeite seit Jahren mit dem Laden bzw. vielen seiner Köpfe zusammen. Leider ist es aber halt genauso wie jede supranationale Organisation halt auch manchmal ein Spielball der Interessen. Und wir Deutsche dürfen angesichts unseres -in Sachen Covid sehr unrühmlichen- Einflusses und Menschen wie Streeck oder unserer unfähigen noch STIKO da den Mund auch nicht zu voll nehmen. Schauen wir erstmal wer jetzt in die neue STIKO kommt)

Von daher: Mal abwarten und ruhig durch die Hose atmen. Okay, vielleicht auch durch die FFP2 Maske, das aber eher wegen normalem Covid. Das ist nämlich gerade viel viel akuter.

Mehrwertsteuer"erhöhung" für die Gastro

Bekannter der aus einer Gastro Dynastie stammt dazu:

"Gibt vier Typen von Wirten die jetzt heulen: Die einen sind geistig nicht aus dem Corona Lieferboom raus gekommen, die anderen haben gemerkt, dass das Finanzamt mittlerweile viel viel genauer kontrolliert und die nächsten haben ein nie wirklich nachhaltiges Geschäftsmodell gehabt. Lemmy and GDPR - What is the current state?

Former (small scale) data protection officer here. While I am long out off the data protection game and there are surely a lot more qualified people out there I maybe can clear up a few misconceptions here and answer a few questions that come up regularly:

(BTW: My first language is not English and all my comments/books on that topic are not in English so excuse me if my translations are sometimes not 100% accurate)

  1. Does the GDPR even apply to a instance hosted outside the European Union?

It absolutely does. And in fact it is harder to comply to the GDPR outside of the European union. The GDPR does apply to all data collectors (from now on DCs) that collect data of European citiziens. While §2 Section 2a GDPR limits the application of the GDPR to usage within EU laws the collection of EU citiziens information clearly falls under the EU law as long as the EU citizien is within the EU during the collection process.

  1. So why is it harder to comply to EU law outside of the EU?

Because of local laws. A good example are US homeland security laws that do contradict the GDPR (and various other EU laws) and therefore make it impossible for someone to host EU data in the US complying to the GDPR. Facebook made a pretty costly experience in that regard recently. To comply to the GDPR one would need to keep EU citiziens out of their service AND defederate all EU instances. More of that later.

  1. Does the GDPR even apply to Lemmy posts?

It absolutely does! GDPR §4.1 states clearly that all information relating to an "online identifier" (aka username) is already protected. So the IP adresses, etc. collected by the initial server aren't even the only personal data. This makes the whole topic a clusterfuck in terms of federation.

  1. But what about my small/medium size instance?

I am not a business! I make no money. The GDPR does not care a bit about ones intentions here - it applies to all instances that are beyond "personal or intrafamiliy" data collection. This basically means that you can absolutely do what you want with the data you collected at the last family reunion. Maybe one can even get away with a invitation only private instance that only caters to a group of friends knowing each other. But any DC having a public instance is not, by definition, a private DC anymore. Therefore the GDPR does absolutely apply.

  1. Can I simply the user for permission to use their data indefinitly and however I want?

One surely can ask that. But that automatically invalidates the agreement. (Funnily enough this is exactly what reddit does and why reddit is not in compliance. Which might turn out costly.) The consent always has to be revokeable, amongst other things.

  1. So what does the GDPR stipulate?

There are three main topic we need to look at: Data deletion, traceability of data transfers and connected to this information about data usage.

Lets start with traceability. Because that makes the federation a federation!

  1. What does traceability of data transfers mean?

It basically means that a DC must record its data transfers to third parties and ensure that data is handled there according to the consent agreement with the user and the GDPR. Usually a data transfer agreement is necessary to ensure the rights of all parties. This makes it so difficult for a federated system: In theory a instance would need a data transfer agreement with ALL instances that federate data from it. And these instances woud then need to make sure that they don't transfer OR their transferpartner is covered in the original data transfer agreement as well their own one. A receipe for a pretty nice clusterfuck.

  1. What does data deletion mean?

Under the GDPR every user has the right to have his data deleted from a DC. This does not include data necessary for legal obligations but basically everything else. So the user can at any point revoke his consent and make the instance delete all their data.

  1. Okay, I deleted the data on my instance, do I now comply to the GDPR? Surely I can simply ask the user to go to the other instances and ask them to remove the data?

No. And here is another problem: The original DC (the users instance) is responsible for the data handled through transfer. That's why one needs a transfer agreement. To ensure that the data is deleted on all instances it was transfered to. There are two exceptions here: "Involuntary data transfer" is generally seen as not being part of the data handling. But that mainly applies to datascrapers like the web archive and similar usage where the data is transfered through general usage of a page that the DC cannot reasonaby prevent without limiting the usage of their service massively. That would very very likely not apply to a service that does provide a specialised api for the transfer. The other one is a data transfer partner not complying. In that case the user can sue the DC, but the DC can sue the transfer partner for breach of contract.

  1. What does right to information usage mean?

Basically a user has a right to know what happened to their data. So in case of the federation: To what instances got my data transfered to? How did they use it? Did they transfer it?

  1. The end: What does that mean for Lemmy?

To be honest: I can not fathom a way that put Lemmy in a position that is fully GDPR compliance. There might be one, but I can't imagine one that does not entail full defederation. But Lemmy can and must urgently improve the GDPR compliance as far as possible:

  • We need tooling for administrators to easily remove a users personal information from their own instances. Currently this is still very bothersome and time consuming manual work as far as I know.
  • We need a tool to federate deletion requests. So once the administrator of the "original instance" deletes the data a request is sent out to all instances and they automatically delete the user data then.
  • We need a system to deal with instances who do not follow deletion requests. This, for example, could include a "karma" system - once you are caught to not delete the userdata you are getting bad karma. And with enough bad Karma you get defederated by more and more instances.
  • We need a tool to inform people which instances did federate their data.
  • We need to optimize data frugality: The less data is collected the better it is.
  • We should consider data transfer agreements between the instances being set up automatically.

In theory even then someone can sue an instance owner. Even then we are not 100% in compliance. But it is a far better position in court if one can argue that they did basically everything they can to ensure the users right compared to "I don't give a f****, your honour".

Additionally we should lobby for change in the GDPR to include better rules for federated systems. Also because E-Mail as another federated system is not in compliance - that can easily be weaponized as a good point.

Edit: Just a few thoughts: Considering all this I personally would make a public instance a company or a association to limit the personal liability. Limited companies and in some EU countries associations limit the personal liability of the owner/ceo/board members massively and while they generally attract much more legal action it is easier to simply close a limited/association if one is in bankruptcy after a lost court case.

Nevertheless, it is still bad karma in court if the other side can prove that one did create a limited company,etc. just to effectively break the law, in that case even then the owner/board member is not protected and their personal assets are up for grabs.

One has to refinance the financial obligations from the limited company/association, though and of course bookkeeping,etc. becomes more burdensome. Especially the refinancing term is harder for a company as Ads do not fly on this platform and in most jurisdictions you cannot accept donations as a company. Therefore a association might be a better plattform.

How is surgery safely performed on the rectum and its connected piping?

Patients are asked to clean their guts before major rectum and colon surgery,similar to what you do when you get a colonoscopy. Ideally that removes most if not all fecal matter and a significant portion of the bacteria.

Furthermore of course the colon is rinsed before the actual surgery and often during the surgery as well if necessary, if necessary with disinfecting solutions (but far less than one would think - it's actually important to do so to the least amount possible,see below). Additionally wound closures are done with techniques that allow extremely easy healing in the most problematic parts and often multiple sutures are made to adapt tissue borders on multiple layers and in multiple ways. And during and after the surgery strong iV antibiotics are given to prevent infection. But it's actually not a good idea to totally get rid of all bacteria. Especially the guts need a healthy bacterial flora to function and,and this is important here, to avoid "bad bacteria" to take over the space. There is more and more focus to make the right bacteria grow back on the colon/and to some extent the rectum, so there are some procedures that are now done with direct faecal transplants afterwards. Nevertheless often patients will not be allowed to eat for quite some time after an operation and are fed with intravascular solution during that time. Not a pleasant experience but sadly necessary. For more external operations (rectum) patients are also given stool softeners (medication that makes the passing of faecal matter easier) and advised to do disinfecting baths often, sometimes three times a day.

And of course the body is quite good at fighting bacteria and the colon and rectum - it is built to do so,the end of the whole "waste producing" system is outside the actual abdomen inside the pelvic sack,separated by a barrier. And the whole area is heavily supplied with blood (which is actually a good thing for infection control).

And last but not least for major operations there is always the option to create an enterostoma - an artificial opening/shortcut for people to get rid of fecal matter through it. These are usually done through the abdominal wall. After everything has healed up (usually after 6 months+x) the now healed colon and the small intestine/unaffected large intestine are connected back together and the artificial opening is closed.

(Sadly this is not always possible - then patients are getting a "Barbie Butt" - a behind without an opening. Mostly for cancer.)

As someone who is doing disaster response consulting for healthcare and public health: I fucking love you guys. You make my job sooo much easier.

Seriously.

The surveillance you folks do is pretty much indisputable and far more incorruptible compared to everything else we do, in healthcare especially.

Very often you are my "discussion ending gun" when decision makers endlessly want me to prove their (flawed) point of view. A "nope, here are validated wastewater based numbers, you are wrong" is extremely satisfying sometimes.

You still have times when there is nothing to do?

I haven't seen that.... in decades.

If there is no patient care there is documentation. If there is no documentation there is administration/supplies. If that is done there is something to clean.

And if that is done there might be a paper/medical book to read.Or discuss a case with someone.

...Okay, you got me...I am a former manager.....

But tbf, we have sacred break times here, but when you work you work. (And well, we have less hours than people in other countries)

Als jemand der Einsatzleiter bei solchen Lagen war und mittlerweile Kommunen u.a. zu sowas berät: Es ist eine imho sachlich richtige Entscheidung,ich hätte in dieser Situation auch nicht über CB alarmiert.

Cellbroadcast ist super wenn du eine sehr große Menge an Menschen über notwendige Schutzmaßnahmen informieren willst. Um beim beliebten Ahrtal Beispiel zu bleiben: "Extremes Hochwasser befürchtet,suchen sie jetzt höhere Lagen auf!"

Bei einer Unwetterlage außerhalb von entsprechenden Geografien hast du das Problem so nicht - das man bei Unwetter "rein" geht ist auch so nachvollziehbar,weitergehende generelle Schutzmaßnahmen hast du nicht.

Gleichzeitig sorgen Alarmierungen aber auch für eine Alarmfatigue - wird zu oft alarmiert nimmt man den Alarm nicht mehr ernst. Ich bin deswegen auch großer Gegner der aus reiner juristischer Absicherung durchgeführten ständigen Alarmierung per KatWarn/NINA für jedes Standardunwetter.

Gleichzeitig ist es eben erwiesen,dass bei gewissen Warnungen (Sirene, CB,etc.) die Anzahl an Anrufen in den Leitstellen massiv steigt - weil eben Hildegard die im 4 Stock oben am Berg wohnt nicht weiß was sie tun soll oder erfahren will ob sie ihren Enkel der auf Madeira wohnt auch warnen muss.(Nope, keine erfundenen Beispiele...)

Dahar ist das alles durchaus nachvollziehbar.

PS: Übrigens handelt es sich entgegen der Meinung vieler Kommentare hier so oder so nicht um unterlassene Hilfeleistung sondern wenn dann um eine Körperverletzung durch Unterlassung im Sinne der Garantenpflicht. Und selbst diese ist hier mit 100% Sicherheit nicht gegeben.

I am all for cannabis legalisation, and have fought for it for years,even though I don't like to consume it (only makes me sick..)

BUT: I have been a medic on the Oktoberfest for a decade and while these times are long gone, I absolutely support the ban there.

Here's why: First Alcohol and THC do not mix well. At all. In more than 20 years of emergency medicine I saw two THC overdoses - which were easy to handle. But high dose alcohol AND THC is a massive problem and will lead to people getting admitted to ICU for monitoring purpose as it is beyond what the (very advanced) medical services at the Oktoberfest can handle themselves. And ICU beds are in absolute short supply. So while alcohol is a problem and I wish the local government would put more pressure on the waiters to force them to refuse to deliver "the final Maß"(last beer) that pushes people over the edge, my former colleagues can easily handle that. But mixed-agent intoxication is a totally different beast. Don't get me wrong, Alcohol will be the main nox in these cases - but the combination is the problem.

Furthermore the Oktoberfest is crowded as hell. And there is literally zero chance that one is able to smoke without interfering with someone else - staff, other visitors, etc. And just like nicotine letting someone else co-consume without asking them for approval is inconsiderate as fuck - especially as there are drugs that do not mix well with THC, even more so even alcohol comes into play.

From my understanding your colleague committed a crime under the Indecent Displays (Control) Act 1981 and you can refer the matter to the police - which I would strongly recommend as this is beyond an employee-employer relationship.

And it brings the employer into a position that the company is forced to make sure that the offender cannot reoffend against anyone (not just you). While the first offense is nothing the company can really be held liable for, anything after they have (officially) made aware they can be held liable for.

Ich hab deswegen schon ein Säugling erfolglos reanimiert.

Weil die Mutter dachte es braucht auch Notfallgebühr für Kinder (brauchte es nie) und die Wahl war: Milchpulver für den Rest der Woche und hoffen das Amt zahlt nach 3 Monaten endlich. Oder das.

Kinder haben leider die Angewohnheit oft lange "ein bisschen" krank zu sein um dann blitzschnell zu dekompensieren. Das ist selbst für (Erwachsenen)-Fschpersonal schwierig zu erkennen.

Vermieterselbstauskunft

Als Kleinvermieter mal ein paar Tips (funktionieren aber nicht bei Konzernen und bei kleineren Vermietern nur wenn es sich nicht um eine Wohnung nach der Einliegerwohnungsregelung handelt):

  • Mit welchem Elektriker/Sanitär/Heizungsbetrieb arbeiten Sie eigentlich zusammen?

(Wenn hier nicht aus der Pistole geschossen wenigstens für einen der Punkte ein Betrieb genannt wird weißt du,dass der Vermieter entweder alles selber macht was meist nicht gut endet oder einfach keinen an der Hand hat weil man nichts repariert/behebt. Es gibt IMMER irgendwas)

  • Welche Firma kommt denn zum Verbrauchsablesen? Und wann wird auf Funk-Verbrauchsablesung umgestellt? (Ist ganz interessant, da man dann gleich sieht ob es selber gemacht wird - was rechtlich möglich,aber praktisch niemals korrekt machbar ist; zweiteres ist bald Pflicht - und viele haben es gar nicht am Plan)

  • Wer macht die Nebenkostenabrechnung?

(Falls es sich nicht um Fachleute aus dem Immobiliengewerbe handelt und sie es selber machen: Sei dir sicher,dass die Abrechnung fehlerhaft ist. Es ist aktuell selbst für Fachleute extrem schwer eine rechtsgültige Abrechnung hin zu kriegen, egal was manche Programme behaupten. Das ist nix was das pensionierte Lehrerehepaar selber machen kann )

  • Wer übernimmt den Winterdienst? Und wie viele Räumungen haben aie bestellt?

(Wichtig,denn es gilt in vielen Städten die Anliegerpflicht - das sind aber ggf. die Hausbewohner, NICHT der Vermieter. Und das ist bei Mehrfamilienhäuser alleine schon haftungsrechtlich ein Alptraum. Und viele Vermieter bestellen halt auch nur 1x ne Morgenräumung. Was billig ist aber nicht ausreicht)

  • Welche Rechtsform nehmen Sie ein? Gibt es weitere Eigentümer?

(Kann einen richtig ficken wenn das Gebäude eine eigene GmbH ist und man so nicht an den Vermieter ran kommt, ebenso kann es im gerichtlichen Verfahren problematisch sein wenn dann raus kommt,dass die Schwester eigentlich auch Mitzeichnungsverpflichteter Eigentümer ist,etc.

  • Wer wartet die Rauchmelder?

(Wenn es Minol ist lauft. Letzter Rotz den niemand guten Gewissens nimmt außer es geht nur ums Geld)

Bei großen Konzernen würde ich gezielt nach Value Add Sachen Fragen,aber das sprengt hier den Rahmen. Das ist aber echt ne Schweinerei.

Have you ever been in an argument where you absolutely objectively proved you were correct?

I do disaster planning for counties,hospitals,big companies,etc.

I had a presentation for a hospital and basically showed them very very detailed how they need to prepare for flash flooding. And I was absolutely shot down and basically booed out of the room. "We never can get flash flooding here, it is impossible, you have no idea what you are talking about!"

Exactly two weeks later you could see them on national news, they had 120cm(around 4 feet) on their ground floor, including their ED.

Even if they had signed us it wouldn't have changed a thing (our recommendations take years to show effects) and people died (it is actually part of one of the worst flash flooding disasters in history,over 220 people died). So I can't be happy about it at all.

But my team and I were very very very much proven right. (And meanwhile even multiple court ordered experts have agreed on our assessment)

For woodworking: Add the "old machines were soooo much safer,you need to use this 1968 Asshole-Wankerville saw if you realllllyyy want to have safety"(not true, especially when using planers) and the "if you don't do it this way you should not be let close to a pencil!"(does it in an antiquated, overly complicated way that is safe but if you do one little thing wrong it isn't anymore)-Gatekeepers.

Especially the whole story around saw-stop and how it was perceived by amateurs (even when they were unaffected by the manufacturers propaganda) is a shame.

Old machines can be good. Old machines can be a deathtrap. And things decay over time and something rotating with 30.000 RPM for 50 years close to someones groin/stomach maybe isn't a risk someones should take lightly.

I have an emergency medicine background, including some accident research. And even then people try to argue with me. "No,that kind of injury can never happen with this brand". Idiot, I have seen it myself,talked to the person who nearly killed themselves, etc.

The thing is that it won't save him from the current inquiry. Once the EU rules that he is in breach of the current legislation (which he clearly is) he owes them a shitload of money. Sure, he chose to not pay(he is mad enough to try). But that would later on make the Twitter penalties his personal problem.

And that is painful even for a billionaire. No more skiing in the Swiss Alps, no more Saint Tropez in the summer, no Monaco. And none of his assets can ever return to the EU or EU friendly allies.

That would probably make him even more mad.

Which I like. A lot.
