Kind of. He was going for his usual strat: sue for bonkers money, get a deal before discovery and whatnot. BBC is calling the bluff. The last thing he wants is to give a deposition / going to discovery. And I did say "need" not "want" deliberately

He opens himself up for discovery. If the judge throws it out, he can avoid that AND not look like he backed down. The judge is doing him a solid.
