its like sex. it can be consensual or nonconsensual and one is a crime. Its why spock could be such a mind slut like when he did kirk, mccoy, and sulu back to back because suposedly they were in danger of being shot at the ok corral.
This was a huge focus of Star Trek Enterprise, the one that chronologically comes before ToS. A lot of Rights arguments were fought then.
