The argument for skull emojis meaning kill seems like a stretch from the prosecutors

Yeah, isn't this "aren't afraid to [die]"? People don't usually ask "are you afraid to kill?". Like, the later isn't a totally invalid question, but it's a weird way to approach it, while "not afraid to die" is a pretty straightforward sort of statement.

I probably wouldn't put that out there either, but at least he could argue that he was being sincere in his concern.

This specific case might be specific enough, but generally saying "kill all cops" or "cops deserve death" would not be.
