Flag Burning Ban Executive Order
The proper method for disposing of a flag is fire as established in the flag code.
Have you read Trump's Executive Order banning flag burning? No exception for disposal. This is one issue I've always had with the idea of a constitutional amendment banning flag burning. Any amendment that has to contain a necessary exception for the exact act it seeks to ban is doomed to ironic failure. Then there is the whole issue that the only successful amendments banning things are to stop the government, not people, from doing things,
Also the wording is weird because it gets into motives and talks about using existing laws, but the existing laws make this completely legal and the motives are irrelevant.
It says that burning a flag is fighting words, but Fighting Words Doctrine has been quietly depreciated over the last few decades. The last major case was 2011. The court found 8-1 that you can say anything you want in public and if someone punches you they go to jail. It's why it's not legal to punch Westboro Baptist Church members with signs at funerals.
This EO was not well thought out. I, know, you're not surprised.
