While I agree, IP laws have come so far from their original purpose that they now do much more to stifle innovation than to bolster it.
Still, just because a dumbass said it, doesn't mean it's a bad idea. (Broken clocks, and all that.) I'm pretty sure this is just lip service, though, as I've no doubt that Tesla and spaceX both have huge patent portfolios that they wouldn't be keen on losing.
