how about approval from congress? or constitutional authority?
Congress has so far done nothing, so they're basically fine with it. And the constitutional authority is decided by the courts, the same ones that ruled that anything a President does is de facto légal.

In the same way that I can walk into walmart and tell every employee they are fired. Which if I can make myself sound important they may leave... I don't have the authority to fire them, but who's going to stop me. First ammendment says we can yell "you are fired" in a crowded theater.
