MERL [McLaren Electric Racing Limited] has acknowledged that its Relevant Costs for the Reporting Period ending on 30 September 2025 exceeded the Cost Cap by GBP 555,628 (4.54%). MERL has therefore acknowledged that it has breached Article 10.7 of the Financial Regulations due to its failure to keep its Relevant Costs under the Cost Cap.
On that basis, MERL has accepted the imposition of the following sanctions pursuant to Articles 8.20(c) and 11.1(a) of the Financial Regulations, which take into account the mitigating factors and the absence of any aggravating factors listed in the second and third paragraphs of this document:
a) MERL must pay a Financial Penalty of EUR 400,000 to the FIA within 30 days of the date of execution of the ABA (Article 11.4 of the Financial Regulations);
b) MERL bears the reasonable costs incurred by the Cost Cap Administration in connection with the preparation of the ABA (Article 8.20(e) of the Financial Regulations).
The decision of the Cost Cap Administration to enter into this ABA constitutes its final decision resolving this matter. In accordance with Article 8.21(d) of the Financial Regulations, MERL has waived its right to appeal or otherwise challenge this ABA. Non-compliance by MERL with any terms of the ABA will result in a further Procedural Breach under Articles 8.22 and 10.1(f) of the Financial Regulations and automatic referral thereof to the Cost Cap Adjudication Panel.
