Amazon employee sues, alleging company failed to protect her after she reported rape by senior manager

The employee stated that when she reported the rape to Amazon and gave credible evidence, the company told her that if she wanted to keep her job, she would have to keep working with the senior manager and not speak about the attack, according to the complaint obtained by MyNorthwest.

“I reported it to HR,” the employee told KIRO Newsradio. “Two days later … they allowed me to continue working with this person. And they told me not to mention anything, which kept me from warning other people. Ultimately, I had to continue working with him in that job if I were to keep it.”

The employee was allegedly raped in October 2023 on an Amazon-funded work trip in New York.

“One evening, after an Amazon-hosted open-bar event ended, numerous Amazon employees and partners, including [the employee] and [the senior manager], continued the gathering at karaoke and bars, all paid for by Amazon,” the complaint stated. “[The employee] and [the senior manager] flirted. They joked. They got along. Towards the end of the night, he kissed her. [The senior manager] persuaded [the employee] to go back to her hotel room with him. But [the employee] did not want to have sex with him. She refused to have sex with him. After all, this is not the 1800s. A man cannot demand a woman have sex with him because she drank, flirted, and was kissed.

“[The senior manager], however, had other plans,” it continued. “In [the employee’s] hotel room, during the early morning hours, [the senior manager] raped her. Before the rape started, she said no. During the rape, [the employee] asked him, ‘You realize this is,’ and [the senior manager] finished her sentence, saying, ‘rape? Yes.’ He ignored her protests. He raped her.”

Should have reported it to the police. Got fired, wrongful termination, then sued. Amazon would choose to settle big over something like this.

You absolute fuckheads:

The employee told a friend about the incident and ultimately decided to report it to police and Amazon. The employee reported the incident to Amazon two days after it happened. She also told other friends and her therapist. The next day, she reported it to the New York Police Department and underwent a rape kit.

The employee also questioned the senior manager with police listening over the phone. He denied having sex with the employee, saying he was “200% sure.” However, days later, he contradicted himself in the police interview, saying he was too drunk to remember, according to the complaint. The employee stated that she gave police a condom the senior manager left behind, and it was tested and came back positive for male DNA.

The employee’s attorney, Jay Free, told KIRO Newsradio that the New York Police Department closed its investigation after exhausting leads.

My solution to what?

To people who come into comment sections without reading the article and blame rape victims for not doing everything perfect following their rape?

You don’t report crimes of your employer to your employer first. That makes no sense. You go directly to the police.

I think people read the article, but just didn’t take your side on it.

I don’t know how you thought people would respond, but…

You can choose to believe victims. You can choose to not pick apart a victim’s actions after they were raped. You can choose to simply say “that sucks, I hope she gets justice.”

But instead you chose to lie about whether she went to the police or not to cast doubt on her story.

I didn’t lie or create any type of falsehood. The article says she reported to her employer, which gave them the advantage. Then she reported to the police, but I guarantee they went to the police before she did to setup a defense.

I think providing advice and guidance for people to better handle these situations is more beneficial.

Internet sympathy is pointless, thoughts and prayers.

If you read the article as you claim, why did you push that she didn’t report to the police?

Internet sympathy is pointless, but internet derision is totally ok?

This isn't her fault. Police often mishandle rape cases.

Amazon should have done the right thing here and not forced her to keep working with her rapist to keep her job.

A cold logical analysis is that from Amazon's side that's somebody claiming to have been raped and, worst, somebody who chose not to report it to the police.

She could be lying, she could be telling the truth. Lying to Amazon HR about a crime can't land you in jail, falsely reporting a crime to the police can, so if she did go to the police with it, that would've make her claim more believable to Amazon HR even if the police did ultimatelly mishandle the case.

I'm not saying that Amazon did the right thing here, and I'm also not saying they did the wrong thing - in the absence of other similar accusations against this manager and given that the person claiming to be a victim didn't even report it to the police, from the point of view of Amazon (and assuming they asked him and he said "No, I didn't do it", something likely both if he was innocent or guilty) it's the word of one of them against the word of the other one by which point they can't really act against him.

All this to say that the previous poster was entirelly right - even just the complaint with the police has value no matter if the end up mishandling the whole thing or not, because it's a very strong indication that the person trully believes they were raped and isn't just spinning a lie.

I am fucking sick of this shit.

Fuck off with your defense of Amazon and your victim blaming.

6

Your gonna look at their response... Saying that she can't even talk about it tonwarn others, and still think they did right?

Two days is enough to run an investigation like that? 48 hours and nothing?

Yeah, they fucked up here by not providing a safe workplace for her.

Edit: let's assume for a moment its fake. Why would you let that person return to work?

It's people like you that forms or participates in mobs to lynch young black men in Southern US States for "raping white girls" merelly because some white girl claimed it happened, stoking each other's moral rage until they catch that person and after gruesomelly murdering them even patting each other on their backs and prancing around full of righteousness for "bringing Justice".

If you think pointing out that the FUCKING LAW will constraint the actions of an employer when faced with a verbal accusation of a crime for which there isn't even a police report is fucking "rape defense" then you're either simple minded or a mindless raging moralist who dreams of inflicting hurt on those which they believe "bad" based on far less than sufficient evidence for a Court Of Law to secure a conviction.

JUSTICE exists, is based in the principles it's based in and works as it works because that simplistic moralistic crap of "I believe somebody when they claim they're a victim" being treated as "proof" enough for punishment ends up destroying innocent lives.

Vigilant "justice" doesn't fix injustice, it just creates even more injustices as plenty of innocent people end up hurt because the standard of "proof" of vigilantism is "I trust this person and they said X, and that's good enough for me" and it turns out plenty of people who seem trustworthy (or, worse, are presumed trustworthy by people who practice Discrimination due to things like gender, race, sexual orientantion) can and do lie.

4 in 5 reported perpetrators are never charged with a crime.

For many survivors, reporting sexual violence means entering a system where the outcome is uncertain. A report may be investigated, cleared, closed, declined, or moved forward—but only a fraction of reported cases lead to criminal charges.

A 20-year review of sexual assault case outcomes found that just under 20% of reported rape and sexual assault cases are criminally charged.

This number points to one reality: many survivors report sexual violence without seeing the person who harmed them formally charged with a crime. 29

Is it because the 4 are innocent or because they are guilty and there wasn't enough evidence? There is no way of knowing which one is it, and that's the reason why conviction rates are low, not because lawyers and judges have all collectively decided that rape is cool.

0

Our president is a rapist. Our entire judicial system does kinda think rape is cool.

1

Reporting to the police does not guarantee justice.

FBI crime data shows that law enforcement clears 26% of reported rape cases. In this data, “cleared” may mean someone was arrested or even that the suspect was deceased; it does not necessarily mean the perpetrator was charged, convicted, incarcerated, or otherwise held accountable.

The clearance rate directs our attention to the 74% of survivors of rape whose cases remain unresolved every year. That’s at least 125,274 people who reached out for justice they may never receive. 28

Your entire read on a example of murderous vigilantism based on accusations of rape and my points on why Justice is needed and works as it works to avoid the injustices of vigilantism is "Race".

Wow!

A person who looks at other human beings and only sees the only hyper-reductive "Race" and "Gender" and still feels entitled to pass judgement on other people.

Wow!

That just super special.

According to the complaint, Danbom and colleagues attended an Amazon-hosted event with an open bar before continuing the evening at karaoke bars. Amazon paid for the gatherings, the lawsuit alleges. Danbom and Simonte flirted and joked earlier in the evening, according to the filing. At the end of the night, he kissed her and persuaded her to let him accompany her to her hotel room.

The complaint alleges Simonte raped Danbom in the early hours of 28 October after she explicitly refused. It says he ignored her protests. Danbom reported the incident to the New York Police Department (NYPD) the following day and underwent a sexual assault forensic examination. She also gave officers a condom that Simonte allegedly left behind, according to the lawsuit.

The complaint says a detective monitored a subsequent telephone conversation between the pair. During the call, Simonte reportedly said he was 200% sure they had not had sexual intercourse. He later told police he was too drunk to remember what happened, according to the filing.

Not saying it’s her fault. Amazon isn’t a company with an unknown track record. The scorpion stings because it is his nature.
