Like yeah it's technically a possibility, but if anything that makes the guy look even dumber. Then we get into things like 'poor maintenance' and root causes for the failure...
From a legal standpoint, I would definitely not try that angle. Even if everything was fine until the few seconds before that intersection, care and maintenance is going to be scrutinized so hard.
