The best we can hope for, under the circumstances, is that Roberts comes to deeply regret that decision, as Trump turns on him.

If Roberts decides trump is on track to put Roberts in a prison cell or work camp, Roberts make express some self preservation before he would no longer have the power to, and actually rule on the side of democracy finally fulfilling his role as a check on power of the Executive Branch. Thats the hope.

They have demonstrated they will overturn themselves based on how they are feeling that day, so I wouldn't rely on getting the same judgement if a similar case comes up and they are pissed at the defendant.

Yeah but they voted 5-4 to release foreign aid on March 4th. Threatening the courts may work, or it may backfire and the court actually defend each other by ruling by the law.

What are they going to do? Sotomayor isn't going to walk down to the oval office with a baton and take trump into custody. An unenforced law is just toilet paper.

Also: They already gave trump the power to get out of anything. Just declare an "official act" to have some navy seals make an opening on the SCOTUS.

Supreme Court is still an important source of perceived legitimacy. The further authoritarians can push the Supreme Court to rubber stamp their power, the weaker public response will be.

Its similar to a form of "divine right" really.

Of course, the Supreme Court has to have its own trust and perceived legitimacy in order to convder it.

The people you asked "who cares about" are not the people signing petitions or expressing anger. They are the majority of Americans that are clueless to the current events going about their daily lives unaware of what is coming. They continue to follow laws because the system of government mostly has a history of following its laws with each branch of government doing its job. If they believe the laws are still just, and the avenues of appeal still exist, they'll continue to follow the laws.

So if the legitimacy of the Supreme Court evaporates thats a huge deal when the rights to appeal and receive a just verdict under the law evaporates along with it. Its going to be awhile yet, but we're on the path to eventually get to the "pick up that can!" stage and everyone will know that refusing will mean unjust treatment by the state. Thats the extreme end, but by that time everyone will know. I'm hopeful it will be before that point that current events curves toward a different outcome.

The supreme court doesn't have a police force to enforce their rulings. JD Vance worked that out before the election. It relies upon the Federal government, as an institution, to follow it's will. Then came MAGA and the LOLs will ensure.

Incorrect. The courts can deputize anyone.

They can make a police force.

Edit: Further, the supreme Court has its own marshal service that answers only to them. The courts are capable of enforcing decisions, this is entirely on purpose.

I don't think that deputising a few people is going to disarm Donnie. Especially after their ruling that any "official acts" he makes are legal and legitimate.

No, it won't. But that's the not the point. The point is that the Supreme Court has the power to enforce their decisions if they have to.

In part of the deputization, they can appoint the power to the Marshal of the Supreme court to deputize necessary individuals.

If Roberts does feel the Supreme Court power is threatened he can do something about it. If he doesn't it's an indication he's in agreement with Trump's power.

It largely hasn't been necessary, but it is there.

Technically they left it to a lower court to determine what an official act is. Roberts believes that they can rein the king in orange in if he ever steps outside the bounds. He's unaware that Trump can now hire blackwater to murder judges because they gave him complete and total pardon power. He can then replace those judges with cronies. It's almost like these people have lived sheltered lives from cradle to gavel

Judges are political appointees so they deliver a political ruling. Everyone is acting shocked. They've been doing this shit for decades. The only difference is that they've turned it up a couple of notches.

Didn't Justice Samuel Alito fly an upside-down flag outside their home in 2021? He blamed his wife, but it was a clear MAGA bat signal, if there ever was one.

You don't have to have political parties pick your preferred brand of justice. Shocking as that might sound, most other western democracies don't do it.

As is by design over a couple of centuries. Law Enforcement is commonly assumed to be only a power of the Executive, but that is not true. All courts, including the supreme Court have the authority to enforce judgements and use funds allocated to the court to do it.

The question is usually do the courts have jurisdiction to do whatever. The whole point of the Chief Justice is that his jurisdiction is not one of the district courts, but the federal district itself.

This is a constitutional crisis in the aspect that Trump is trying to build support for ending the division of powers. Of course, anyone who knows history will see where this is going, but Roberts knows he is complicit in the outcome, regardless of what happens.

supreme court and congress better act soon while they have any relevance. A resume being the complacent judge or congressman who let the us system of government fall to totalitarianism is not going to go far or live long. None of them will outlive their usefulness which is almost gone.
