Do you mean like LLaMA
LLaMA is much more open than OpenAI or Google, but I don't think it qualifies as FOSS.
It's only not FOSS in the sense that you can't train other models with it and 100mau companies can't use it. That's pretty reasonable to me imo, except the lack of training.
